Terms & Conditions
These Terms & Conditions govern your access to and use of Arkalogi's custom trading strategy development, trading products, and related services offered in India. By engaging with our platform, you agree to the rules and responsibilities outlined below.
1. Acceptance of Terms
By using our services, you confirm that you are at least 18 years old, have the legal capacity to enter into agreements, and accept these Terms & Conditions. If you are using our services on behalf of an organization, you confirm you have the authority to bind that organization to these terms.
2. Scope of Services
We provide custom trading strategy development, trading products, and related advisory support tailored to client requirements in India. Deliverables, timelines, and service parameters are detailed in the applicable order form or statement of work.
3. Use of Services
You agree to use our services only for lawful purposes and in accordance with any documentation we provide. You must not attempt to reverse engineer, circumvent security controls, or misuse our APIs, dashboards, or software. We may suspend access if we detect unauthorized activity or misuse.
4. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any suspected unauthorized access. Arkalogi is not liable for losses resulting from compromised accounts where reasonable security practices were not followed.
5. Fees and Billing
Pricing, payment terms, and billing cycles will be outlined in the applicable order form or subscription agreement. Unless otherwise stated, fees are non-refundable. You remain responsible for any applicable taxes, except those based on Arkalogi's income.
6. Intellectual Property
Arkalogi retains all rights, title, and interest in its software, code, designs, trademarks, and content. You receive a non-exclusive, non-transferable right to use our services during your subscription. You may not copy or distribute our materials without written consent.
7. Third-Party Services
Our services may integrate or rely on third-party tools or data sources. We are not responsible for disruptions, data accuracy, or changes made by third parties. Your use of such services may be subject to additional terms from the third-party provider.
8. Disclaimers
Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
9. Limitation of Liability
To the maximum extent allowed by law, Arkalogi will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues arising from your use of our services. Our aggregate liability is limited to fees paid for the service during the twelve (12) months preceding the event.
10. Termination
Either party may terminate access in accordance with the applicable agreement. Upon termination, your right to use the services ends immediately, and you must cease all use. Sections relating to intellectual property, disclaimers, limitations of liability, and governing law will survive termination.
11. Governing Law
These Terms & Conditions are governed by the laws of India, without regard to conflict of law rules. Any disputes will be resolved in the courts located in the relevant jurisdiction in India.
